III. The Online Marketplace
Refusal of Participation: Camping World has the right, at our complete discretion, to refuse participation in any online sale lot and to reject any purchase offer.
Registration
You must complete and sign a registration form and provide identification before participating and/or submitting an offer. We may require bank or other financial references and/or a credit card verification.
Offers (Bids)
When making on offer, you are agreeing to pay the amount offered if such offer is accepted by Camping World, and acknowledge that you will also be responsible to pay any applicable transaction fee, all applicable taxes and all other applicable charges.
Making an offer does not guarantee a sale, even if you are the highest offer received. Sale of a unit via the online marketplace is only final when the buyer has entered into a final purchase agreement with Camping World. Camping World has the right at its absolute and sole discretion to refuse any offer. No offer is accepted until expressly accepted by Camping World.
Buy It Now
Though you can still make offers on these lots if you wish, you can also purchase them immediately for a predetermined price. After clicking the Buy Now button you will be contacted by our sales team to complete the sale and title documents and provided with the invoice which you must pay within 2 business days. If the invoice is not paid within 2 business days, the lot will be relisted.
IV. After the Sale
Completion of Sale and Title Documents
No sale is final until a buyer completes any necessary agreements to effectuate the sale of the unit and title transfer, as provided to buyer by Camping World. You agree to promptly complete any such agreements to necessary to effectuate the sale and title transfer.
Online Transaction Fee
In addition to the final online sales price, you agree to pay Camping World an online transaction fee of 3% of the final online sales price. The final online sales price plus the online transaction fee will be the total purchase price.
Titles, Registration, and Document Fees
For each unit purchased, you agree to pay any applicable document fee charged to purchasers at the location of the dealership selling the unit. You also agree to pay all applicable title and registration fees, which may be higher for out of state buyers. Once payment is made in full, we will complete the title and registration paperwork. You are responsible for providing Camping World an accurate address and information for purpose of us sending you the title and accompanying paperwork.
Sales Tax
All sales made at the online sale are subject to applicable taxes and fees in connection with the purchase.
Payment
All buyers must pay, at minimum, a $2,500 deposit on their purchased unit the day the offer is accepted by Camping World.
You must pay the entire amount due (including the final online sales price, online transaction fee, all applicable taxes and other charges) no later than the third (3) business day following the day the offer is accepted by Camping World.
Payment must be in U.S. dollars and may only be made with cash, credit card (up to $5,000) (Mastercard, Visa, Discover), cashier's check drawn on a U.S. bank, money order, or wire transfer. Any other payment form must be expressly pre-approved by Camping World in writing. You agree to pay Camping World a handling charge of $50 for any payment dishonored by the drawee.
Collecting Purchases
Once Camping World has received all funds due, you shall arrange a time with Camping World to pick up your unit from the selling dealership. Units not collected within 7 calendar days of the final online sale may incur storage charges which will be your responsibility. Camping World shall have no liability for any damage to property left on its premises for more than the stated pick-up days following the sale. Items which have been left unpaid and not picked up will remain property of Camping World and resold at our discretion.
Shipping
Although shipping may be available on certain units, arranging shipping is your sole responsibility. There may be additional fees as determined by the shipping company, which will be your responsibility. All items must be paid for in full prior to removal.
Non-Payment
If we do not receive your payment in full when due, we are entitled in our absolute discretion to exercise one or more of the following measures, in addition to any additional actions available to us by law: (a) to impose a late charge of one and a half percent (1.5%) per thirty (30) days of the total purchase price; (b) to hold you liable for the total amount due and to begin legal proceedings for its recovery together with interest, legal fees and costs to the fullest extent permitted under applicable law; (c) to cancel the sale; (d) to resell the unit; (e) to offset against any amount owed; (f) to not allow any offers at another online sale by or on behalf you; (g) to take other action as we find necessary or appropriate. In addition, you will be deemed tohave granted Camping World a security interest in, and we may retain as collateral security for such obligations to Camping World, any property in our possession owned by you. At our option, payment will not be deemed to have been made in full until we have collected funds represented by checks, or in the case of bank or cashier's checks, we have confirmed their authenticity
V. Liability
Condition Reports
Camping World is not responsible for the correctness of any statement of any kind concerning any lot, whether written or oral, nor for any other errors or omissions in description or for any faults or defects in any lot. Neither Camping World nor its respective officers, employees or agents, give any representation, warranty orguarantee or assume any liability of any kind in respect of any lot with regard to merchantability, fitness for a particular purpose, description, size, quality, or condition.
Legal Ramifications
The rights and obligations of the parties with respect to these Terms, the conduct of the online sale or Camping World and any matters connected with any of the foregoing shall be governed and interpreted by the laws of the jurisdiction in Illinois. If any part of these Terms is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the Terms shall continue to be valid to the fullest extent permitted by law.
Modifications
Any and all of the conditions may be waived or modified in the sole discretion of Camping World.
